In these Terms, "BMR", "we" and "us" mean BMR Cinema Operation Services. "You" and "the Client" mean the person or
company hiring equipment or crew from us.
2. What a request on this website is
Submitting a request through this website is not a confirmed booking. It is a
request for us to check availability and issue a quotation. A booking exists only once BMR has
issued a written quotation, you have approved it, and any required reservation deposit has been
received and acknowledged by us.
Prices shown on this website are indicative daily rates in Philippine Pesos (₱)
for planning purposes. The quotation BMR issues is the binding price.
3. Rental period and rates
- One equipment rental day = 16 hours, beginning at the agreed call time or at
pick-up, whichever comes first.
- One crew working day = 12 hours — shorter than the equipment day, so a
long shoot can put crew into overtime while the equipment is still inside its period.
- Overtime is 10% of the applicable daily rate for each commenced hour, and
equipment and crew are calculated separately, each on its own daily rate and
its own included period.
— Equipment: once overtime reaches 8 hours it converts
to one additional full rental day, covering the next 16-hour period, and the same calculation
repeats for any further extension.
— Crew: once overtime reaches 10 hours the crew rate
converts to double pay.
(Clauses 12 and 15 of the Rental Agreement.)
- Transportation, meals and separately quoted third-party costs are not included
in the overtime calculation unless we state so in writing.
- Multi-day hire is charged on our published day-rate scale, which reduces the effective daily
rate as the hire lengthens. The exact figure appears on your quotation.
- Equipment returned later than the agreed return time may be charged additional rental days.
Late-return charges are set out in the Rental Agreement you sign at release.
- Bookings outside Metro Manila carry a 15% out-of-town surcharge unless the
quotation states otherwise. Transport, shipping, permits, per-diem and accommodation for
crew are billed separately where applicable.
- Outstanding balances beyond 15 days from the due date carry
5% monthly interest, and we may decline to release equipment to a Hirer
with unpaid balances from a previous rental (clauses 21–22).
- BMR is Non-VAT registered. Where VAT appears on a document issued to you,
it is stated explicitly on that document.
4. What you provide on every booking
These apply to all rentals and are reflected in your quotation, so please budget for them when
you plan. They are set out in full in clauses 12, 14 and 15 of the Rental Agreement you sign at
release.
- A BMR caretaker or crew is required on every rental, at the applicable rate
for that role. This is not optional — our equipment goes out attended. It appears on your
quotation as a separate required line, “Required BMR Caretaker/Crew”,
never as an optional add-on. Their working day is 12 hours and their overtime
is calculated on their own daily rate.
- Transportation for the production team, and for equipment pick-up and
return, is provided by the Hirer unless we agree otherwise in writing.
- Individually packed proper meals for the production team are provided by the
Hirer unless we agree otherwise in writing.
- Food, lodging, permits, insurance and travel arrangements for crew or technical personnel
remain the Hirer's responsibility.
5. Reservation deposit and payment
- Dates are held only once a reservation deposit of 30% of the quoted total
(or another amount stated on your quotation) has been received.
- The balance is due in full before the equipment is released, unless we agree otherwise in writing (Rental Agreement, clause 20).
- Accepted payment methods are listed on your quotation and at checkout. Online card and
e-wallet payments are processed by our payment provider; BMR does not store your card details.
- Documents you may receive over the life of a booking: Quotation, Statement of Account,
Rental Agreement / Waiver, Invoice and Official Receipt.
6. Client obligations
- Provide valid government-issued identification and, for company hires, authorisation to
transact on the company's behalf.
- Inspect all equipment at release. Signing the release document confirms you received the
listed items in working order.
- Use equipment only for its intended purpose, by competent operators, and within the
manufacturer's specifications.
- Not sub-rent, lend, pledge, sell or move the equipment outside the agreed location or
territory without BMR's written consent.
- Keep the equipment secure and insured for the whole hire period where required by the
Rental Agreement.
- Report any loss, theft, accident or damage to BMR immediately.
7. Loss, damage and liability
Risk in the equipment passes to you at release and returns to us on acceptance of the return
inspection. You are responsible for loss of, theft of, or damage to the equipment during that
period, regardless of cause, except for fair wear and tear and except where the loss is caused by
a pre-existing fault in the equipment.
- Damage: you are liable for the cost of repair, plus the rental income lost
while the item is out of service.
- Loss, theft or damage beyond economic repair: you are liable for the
replacement value of the item.
- Repair and replacement charges are evidenced by supplier quotations or invoices.
BMR's total liability to you in connection with any booking is limited to the amount you have
paid us for that booking. BMR is not liable for indirect or consequential loss,
including lost shooting days, lost profit, talent or location costs, or reshoot costs, however
caused. Nothing in these Terms limits liability that cannot be limited under Philippine law.
8. Equipment availability and substitution
Equipment is hired subject to availability and to its safe return from a prior booking. If an
item becomes unavailable through no fault of ours, we will offer an equivalent substitute or, if
none is acceptable to you, refund the amount paid for that item. That refund is your sole remedy.
9. Crew
Every rental goes out with a BMR caretaker or crew (section 4); the role and its
rate appear on your quotation. Day rates, call times, overtime and meal provisions are stated on
the quotation. Crew rates are quoted on request and are not published on this website.
10. Cancellation
Cancellations and changes are governed by our Cancellation &
Refund Policy, which forms part of these Terms.
11. Privacy
Personal data you give us is handled under our Privacy Policy, in
accordance with the Data Privacy Act of 2012 (Republic Act No. 10173).
12. Governing law and disputes
These Terms are governed by the laws of the Republic of the Philippines. We ask that you first
raise any dispute with us directly so we can try to resolve it — see
Customer Service. Any dispute that cannot be resolved that way shall be
submitted to the exclusive jurisdiction of the proper courts of Parañaque City, Metro Manila.
13. Changes to these Terms
We may update these Terms. The version in force for your booking is the version published on
this page on the date your quotation was issued.
14. Order of precedence
If there is a conflict between documents, the following order applies: (1) the signed Rental
Agreement / Waiver, (2) your approved quotation, (3) these Terms and Conditions.
